KYANOVO creates premium nutrition for longevity and cellular health, and offers an independent Affiliate business opportunity. This page sets out, in plain English, the limits of what we say about our products, the science behind them and the opportunity.

Please read it together with our Terms & Conditions, Privacy Policy, Cookie Policy and Refund & Shipping Policy. If you are an Affiliate, also read the Affiliate Policies & Procedures.

1. Who we are and where these disclaimers apply

KYANOVO Health & Wellness is a brand of Kyanovo International LLC ("KYANOVO," "we," "us" or "our"), based in Orlando, Florida.

These disclaimers apply to:

• kyanovo.com and every page on it;
• every member store at kyanovo.com/<username>/shop;
• the Affiliate back office;
• our emails, product pages, presentations and other materials we publish; and
• statements Independent Affiliates make about KYANOVO, as explained in section 6.9.

Our products are sold and shipped within the United States only, and our content is written for a U.S. audience. Affiliate enrollment is open to residents of the United States only.

These Legal Disclaimers form part of our Terms & Conditions.

2. Dietary supplement statement

Wherever this statement appears, or wherever an asterisk (*) marks a statement about a product, this notice applies:

These statements have not been evaluated by the Food and Drug Administration. This product is not intended to diagnose, treat, cure, or prevent any disease.

Our site footer and member stores carry the same statement, marked with an asterisk, with its second sentence worded for our products as a whole: "These products are not intended to diagnose, treat, cure, or prevent any disease."

KYANOVO products are dietary supplements, unless a product's label identifies it as a food. The label on each package shows how that product is classified.

A few points to understand:

• No pre-approval. Under U.S. law, the FDA does not approve dietary supplements for safety or effectiveness before they are sold.
• Support, not treatment. When we describe what an ingredient does, we mean how it may support the normal structure or function of the body. We do not claim that any KYANOVO product treats or prevents a disease.
• Research on ingredients, not on our products. When we summarize published research, we are describing what researchers studied and found about an ingredient, such as L-ergothioneine. That research was not conducted on KYANOVO products, and its findings are not claims about what our products do. Section 5 explains this in more detail.

3. Not medical advice

Everything we publish is for general information and education. It is not medical advice, and it does not replace a conversation with a doctor or other qualified healthcare professional. Using our site or products does not create a doctor–patient relationship with anyone.

Talk to a healthcare professional first

Consult your healthcare professional before using any dietary supplement, and especially if you:

• are pregnant, trying to become pregnant or nursing;
• take any prescription or over-the-counter medication;
• have a medical condition, or are being treated for one;
• are planning surgery or a medical procedure; or
• are under 18. Our products are intended for adults 18 or older.

Use our products as directed

• Read the label. Check the ingredients, serving size, allergen information and warnings on the package you receive before use.
• Watch for caffeine. Products made with coffee, such as Ergo – Instant Espresso, may contain caffeine. Take this into account if you are sensitive to caffeine or limit it for any reason.
• Stay within the serving size. Do not take more than the recommended amount.
• Store safely. Keep products out of the reach of children.
• Stop if something feels wrong. If you have an unexpected reaction, stop using the product and contact a healthcare professional. In an emergency, call 911.

Never ignore professional medical advice, or delay seeking it, because of something you read on our site, in our emails or from an Affiliate.

Reporting a reaction

If you think you have had a reaction to a KYANOVO product, please email us at support@kyanovo.com. You can also report it directly to the FDA through its MedWatch program at fda.gov.

4. Individual results vary

Everyone's body is different. How you respond to a product can depend on your diet, sleep, activity, age, genetics, overall health and how consistently you use it. We cannot promise that you will experience any particular result, or any result at all.

Testimonials and reviews

When customers, Affiliates or others share their experience with KYANOVO:

• it is one person's experience, not a typical or expected result;
• it is not scientific proof that a product works;
• it has not been evaluated by the FDA; and
• any connection with KYANOVO must be disclosed. That includes earning commissions as an Affiliate, or receiving free product, payment or another benefit.

Images on our site that show people are for illustration and may show models rather than customers.

5. Scientific research and references

We share research because we believe good science deserves a clear explanation. It also deserves careful limits.

• Not studies of our products. Unless we clearly say otherwise, the clinical studies and results we describe were not conducted on KYANOVO products. They are independent, published research on the ingredients themselves, such as L-ergothioneine, PQQ, spermidine, Alomac® (Aloe macroclada) and coffee. None of that research tested our products specifically.
• The findings belong to the studies. When we describe what a study found, including any health condition the study examined, we are reporting the published findings of that study's researchers and sponsors. Those findings concern the ingredient that was studied. They are not KYANOVO's claims, and they are not claims about our products.
• Links to the published research. Where we cite a study, we link to its published record, for example on PubMed, so you can read the research for yourself.
• How amounts were chosen. Where we say the amount of an ingredient in each serving was chosen based on published clinical evidence, we mean that the research guided our formulation. It does not mean our product will produce the same results reported in that research.
• Different kinds of evidence. Some research is carried out on cells or in animals, and its findings may not apply to people. Some research is observational. It can show that two things are linked, but not that one causes the other.
• Summaries, not the whole picture. Our descriptions are simplified summaries. Science changes, and later research may confirm, qualify or contradict earlier findings.
• No endorsement. Referring to a study, researcher, journal or institution does not mean they endorse KYANOVO or our products.

6. Earnings disclaimer

The KYANOVO Affiliate opportunity is a business. Like any business, it carries costs and risk, and results differ widely from person to person.

6.1 No guaranteed income

Becoming an Affiliate is not a job, not employment and not a promise of income. We do not guarantee that you will earn any money.

You may earn little or nothing. You may spend more on products than you earn in commissions. Never spend money you cannot afford to lose, and never buy product you cannot use or sell in the hope of earning commissions.

6.2 What earnings depend on

Any income you earn depends on many factors, including:

• the time, effort and skill you put into your business;
• genuine retail sales made through your member store;
• product purchases by the customers and Affiliates in your organization;
• whether you meet the qualification rules of the KYANOVO Compensation Plan in each period;
• refunds, returns and chargebacks (see section 6.7); and
• competition, market conditions and the wider economy.

6.3 How the opportunity works

• Joining is free. You do not have to buy anything to enroll as an Affiliate.
• Retail Bonus for everyone. Every Affiliate can earn the Retail Bonus on retail sales from their member store. An Affiliate who is not Active can earn only the Retail Bonus.
• Active status for everything else. To be eligible for the other commissions and bonuses, you must be Active. That means at least 14.3 Product Points (PP) from your own pack purchases in a rolling 31-day period. You must also meet each bonus's own qualifications.
• Paid on products, not on recruiting. Commissions come only from purchases of KYANOVO products by customers and Affiliates. Product Point packs are prepaid credit for KYANOVO products. No one is paid simply for enrolling a new Affiliate.
• Packs are non-refundable. Product Point packs, including autoship pack charges, are non-refundable, except for refunds the law requires and the inventory buyback described in section 6.6. Our Refund & Shipping Policy explains this in full.
• Autoship is optional. You never need autoship to join, stay Active, advance in rank or earn. You can add or cancel it at any time in your back office. To avoid the next charge, cancel before your next billing date. No further autoship charges are made once you cancel.
• Buy only what you need. Buy only the product you can reasonably use, share or sell. Do not buy extra product just to qualify for a rank or bonus. The Affiliate Policies & Procedures explain this rule in full.

6.4 Income Disclosure Statement

An Income Disclosure Statement shows what Affiliates actually earn. The KYANOVO opportunity is new, so we have not published one yet. We intend to publish one once there are enough results to report.

Until it is published, no one, including KYANOVO staff and Affiliates, may make any statement about what Affiliates earn, have earned or typically earn. The Affiliate Policies & Procedures set out the full rules on income claims.

6.5 Examples, ranks and recognition

• Examples are illustrations. Any figures in the Compensation Plan, presentations or training show how the plan calculates pay. They are hypothetical. They are not typical results, expected earnings or projections.
• Titles are not income. Rank titles, from Director to Ambassador, and the one-time Rank Bonuses that go with them reflect qualification under the plan. Holding a title does not indicate what anyone earns.
• Founding Affiliates. Founding Affiliate recognition, priority placement in the Binary, the opportunity to serve on the KYANOVO Advisory Board and invitations to KYANOVO Club Retreats are recognition benefits.
  • Priority placement does not guarantee volume, cycles or earnings.
  • Advisory Board seats and retreat invitations are limited and offered at our discretion.
  • Retreat dates, locations and format may change, and a retreat may be cancelled. Whether travel costs are covered depends on the terms of each invitation.
  • The program runs only under its own written terms, as Section 25 of the Affiliate Policies & Procedures explains.

6.6 Not an investment

Product Point packs, your Point Balance and your FBK Balance are purchases of product. They are not investments, securities or deposits, and you do not earn a return simply by holding them.

FBK ("Fulfilled by KYANOVO"). Once you have bought 500 PP in packs in total (refunded or disputed packs do not count), you may move points into your FBK Balance. Your balance can then be used to fill retail orders placed in member stores.

• Orders follow a fixed routing order: the store owner first, then up the sponsor line, nearest first. Stockists who are not Active are skipped.
• We do not guarantee that any order will be filled from your FBK Balance, or how many or when.
• FBK profit is earned only when an order is actually filled from your balance.
• When an order is filled, you also receive principal recovery: a repayment for the product you supplied, at the inventory value set in the Compensation Plan. It can be less than you paid for those points, for example for points moved from a join pack. It is a repayment, not commission.

How FBK inventory is held is set out in Section 14 of the Affiliate Policies & Procedures.

Inventory buyback. When your Affiliate account closes, whether you cancel it or we end it, you may ask us to buy back your unused Product Points, including those in your FBK Balance, that came from packs bought in the 12 months before your request. We pay 90% of the net price you paid for them. Your request must reach us within 30 days of the closing. Section 28 of the Affiliate Policies & Procedures sets out the details.

6.7 Refunds, chargebacks and reversals

When a purchase is refunded, disputed or charged back, we reverse what that purchase created. That includes:

• Product Points that have not yet been spent;
• qualification and volume;
• commissions and bonuses;
• Binary cycles and the Bonus Kash they produced; and
• rank effects.

Commissions that have not been paid yet are cancelled. Commissions that have already been paid are recovered from the earner's balance. That balance may become negative, and future earnings are applied to it first.

All refund requests must go through KYANOVO Support at support@kyanovo.com. A chargeback or payment dispute filed instead of contacting Support is treated as fraud, because it is an attempt to keep goods or Product Points without paying for them, and as a material breach of our terms. A $30 chargeback fee applies, the account is terminated, the related Product Points, commissions and bonuses are reversed, and KYANOVO may pursue recovery of any amount owed. Section 10 of our Refund & Shipping Policy explains this in full.

Because of this, earnings shown in your back office may be adjusted later.

6.8 Your costs and taxes

Affiliates are independent business owners, not employees, agents or partners of KYANOVO.

You are responsible for your own business expenses. These include any products you choose to buy, marketing, travel, internet and mobile service, and events. You are also responsible for your own taxes. Commissions, and non-cash awards such as Bonus Kash and travel, may be taxable.

KYANOVO does not give tax, legal or financial advice. Speak to a qualified adviser about your own situation.

6.9 Statements made by Affiliates

Each Affiliate runs an independent business. KYANOVO hosts every member store and fulfills and ships its orders. Each store is labeled as an independent member store.

An Affiliate's name, photo and bio are their own, and so is anything they say on their store, on social media or in person. Those statements are not made by KYANOVO.

Affiliates may make product and income statements only if they match KYANOVO's official materials, and they must disclose that they earn commissions. If you see an Affiliate making medical claims or promising income, please tell us at support@kyanovo.com.

7. Points, balances, Bonus Kash and travel

The back office shows several balances. This table explains what each one is, and what it is not.

Redeeming Bonus Kash and the Travel balance, including what counts as eligible KYANOVO travel, follows the terms we publish when travel offers become available. The terms of the travel suppliers involved may also apply. All travel is subject to availability.

8. Forward-looking statements

Some of our content describes things we plan to do. These include:

• new products and features;
• events, Club Retreats and the Advisory Board;
• expansion to new countries; and
• the future growth of KYANOVO.

These statements reflect our intentions when we wrote them. They are not promises, and plans can change for many reasons, some outside our control. Please do not base a purchase or business decision on them. We are not obliged to update them, except where the law requires it.

9. Accuracy of information

We work to keep our information accurate and current, but mistakes can happen.

• The label comes first. The label on the package you receive is the authoritative source for ingredients, serving size, allergens and warnings. Formulas and packaging may change over time.
• Images. Product colors and packaging may look different on your screen. Lifestyle photography is illustrative.
• Prices. Prices may change. The price you pay is confirmed from our system at checkout. How we handle errors in prices or descriptions is explained in our Terms & Conditions.
• Availability. Products may sell out or be discontinued, and we ship within the United States only.
• Educational content. Articles and emails reflect what we knew when they were written. Information may become outdated, and we do not always update older content.

10. Third-party links, services and content

• Payments. Payments are handled by Stripe on its own hosted checkout page. Stripe's terms and privacy policy apply to the details you enter there. KYANOVO does not receive your full card or bank account numbers.
• Embedded media. Some pages may embed videos from YouTube in its privacy-enhanced mode. YouTube's own terms apply to that content.
• Links. We may link to studies, publications or other websites. We do not control those sites, and a link is not an endorsement. We are not responsible for their content, accuracy or privacy practices.
• Affiliate channels. Social media pages, groups and other channels run by Affiliates are not operated by KYANOVO.
• Ingredient brands. When we name an ingredient supplier or a branded ingredient, that company has not necessarily reviewed or endorsed KYANOVO.

11. Trademarks and copyright

KYANOVO, the KYANOVO wordmark and logo, the KYANOVO sun-and-leaf emblem, Tomorrow Starts Within, Ergo and Ruby Rush are trademarks of Kyanovo International LLC.

The Affiliate Policies & Procedures govern how Affiliates may use them. Anyone else needs our written permission.

All content on our site, including text, graphics, photography, video and design, is owned by Kyanovo International LLC or used under license, and is protected by copyright. All rights reserved.

Alomac® is a trademark of its owner. Stripe, Apple Pay, Google Pay and YouTube are trademarks of their respective owners. Naming another company's mark does not mean that company endorses or is affiliated with KYANOVO.

12. What these disclaimers do not change

We provide general information on our site as it is. To the fullest extent permitted by law, we make no promise that it is complete or free of error.

Nothing in these Legal Disclaimers limits:

• the 30-day Satisfaction Guarantee on products described in our Refund & Shipping Policy; or
• any right you have under consumer protection law that cannot be waived.

We may update these Legal Disclaimers as our products, the Compensation Plan or the law change. Each time we do, we will revise the "Last updated" line beneath the title. The version posted here applies from that date.
